Terms and Conditions for the Raffle “Sennheiser Profile Wireless”

From 01.11.2024 through 30.04.2025 you can participate in an entirely voluntary survey on Sennheiser Profile Wireless. Once you have completed the survey, you may choose to participate in a raffle for one Sennheiser HD 25 per month.

The below Terms and Conditions and the Privacy Notice attached as Annex (hereinafter together “Terms and Conditions”) shall apply to this raffle conducted by Sennheiser electronic SE & Co. KG. By entering this raffle, participant accepts these terms and conditions.

1. Organizer

This raffle is organized by Sennheiser electronic SE & Co. KG, Am Labor 1, 30900 Wedemark, Germany (“Organizer”). 

2. Who can participate?

a. Anybody who is of age according to the applicable laws at the venue of their ordinary residence may participate in the participating countries.
b. Participating countries are member states of the EEA (European Union member states including Iceland, Norway and Liechtenstein), UK, Switzerland, Turkey, USA, Canada, Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, Panama, Dominican Republic, Cuba, Puerto Rico, Haiti, Brazil, Argentina, Bolivia, Chile, Ecuador, Colombia, Paraguay, Peru, Uruguay, Venezuela, India, Singapore, Hong Kong (China), Japan, Australia and New Zealand.
c. Excluded from participation are employees of the Organizer and companies affiliated with the Organizer or their employees. 
d. Acknowledgement of and compliance with these Terms and Conditions is a prerequisite for participation.
e. Organizer may exclude participants from this Raffle if they attempt to influence the draw in an unfair and/ or dishonest manner.

3. How does it work? 

After having completed the Sennheiser Profile Wireless-survey, each participant has the chance to win once during the duration of the raffle one Sennheiser HD 25.

a. Firstly, fill out the online survey questionnaire.  You can find the link and the QR code to the survey on the small leaflet in your Profile Wireless package.

b. Secondly, go to the webpage https://mautic.sennheiser.com/profile-wireless-survey. 

c. Subsequently, you can freely choose to participate in the raffle and provide us with your name and email address so that we can contact you if you win. 

d. Finally, you will receive a confirmation email right after sending your data to us with a request for verification. Hereto, you should respond to as stated therein. 

4. Procedure

a. The participant shall read and hereby agrees to these Terms and Conditions and the Privacy Notice in full before participating.

b. The Participant shall give the contact data correctly in the form of the email address and thus confirm that the address given is the respective correct address.

c. Only participants having completely and correctly completed the entry forms and who comply with these terms and conditions of the raffle shall be entitled to participate in the raffle.

d. Each participant in the raffle can only participate once during the term of this raffle in the prize draw.

e. Any participation using automated procedures or similar devices or procedures shall not be permitted.

f. The Organiser shall have the right to exclude participants from the raffle at any time who violate the terms and conditions of participation or the good manners and/or otherwise attempt to influence the draw in an illegal, unfair and/or inappropriate way.

5. Place and period of participation

Participation is possible online on https://mautic.sennheiser.com/profile-wireless-survey between 01.11.2024, 0:00 CET and 30.04.2025, 23:59 CET.

6. Procedure for determining the winners

After the end of each month of the duration of the survey and within a period of 30 days after the ending of the period of participation pursuant to section 5, the Organizer shall draw the winner from all participants having participated in the survey of the respective month and who indicated their wish to participate using the form provided by the Organizer by using a random number generator.

7. Information of the winner and sending of the prize

a. The Organizer will inform the winner via email asking for full name, age and address to send out the prize.

b. If the winner does not respond within 14 days after being informed about the prize via email this winner will have no right to claim the prize or any other compensation instead and a new winner will be drawn. 

8. Data protection

While conducting the raffle, personal data of the participants will be processed in accordance with the attached Privacy Notice (see Annex below).

9. Non-dependence on payments

Participation in the raffle shall not depend on any purchase from or payment to the Organiser. In addition, a purchase or a payment shall have no influence whatsoever on the odds of winning a prize. However, it is necessary to complete the review. The odds of winning a prize depends on the number of participants in the raffle in relation to the number of prizes to be won.

10. Suspension, Interruption or Termination of the Raffle

The Organiser reserves the right to terminate, suspend terminate the survey and/or the raffle at any time in its sole discretion.

11. No cash out

A prize awarded cannot be paid out in cash.

12. Liability

The Organizer is liable for intent and gross negligence. In the event of slight negligence, the Organizer shall only be liable for breach of a material contractual obligation (“Kardinalpflicht”), the fulfilment of which is essential for the proper performance of the contract and on the observance of which the participant may regularly rely, as well as for damage resulting from injury to life, body or health.

13. Applicable Law; Venue; Severability Clause

These Terms and Conditions and any disputes arising out of or relating to it shall be governed by the laws of the Federal Republic of Germany without regard to its conflict of laws rules and without regard to the UN Convention on Contracts for the International Sale of Goods (CISG). Any legal action or proceeding shall be brought before the competent courts in the Federal Republic of Germany at Hannover, Federal Republic of Germany.

If any provision of these Terms and Conditions is held invalid or unenforceable by any court of competent jurisdiction, the remaining provisions of these Terms and Conditions shall remain in full force and effect.

ANNEX - PRIVACY NOTICE

The following personal data can be processed while conducting the raffle:

• master data (e.g. first name, last name)

• address data (e.g. street, postal code)

• contact data (e.g. telephone number, e-mail address)

•  individual data in relation with the respective raffle.

The processing is based on the consent of the participants according to Art. 6 para. 1 a) GDPR.

Any data collected from the participant shall be used by the Organizer only to conduct the raffle and in particular to determine and notify the winner and send out prizes. 

The personal data is processed independently of the answers to the survey questions and are is not merged with these.

Any other use beyond the purposes described herein or any disclosure of personal data to any third parties shall not occur. In particular, the collected data shall not be used for any other marketing purposes.

The personal data collected from the participant will be deleted as soon as the purpose required for processing has been achieved. Due to legal requirements, different retention periods may apply.

The participant has the right to withdraw his consent at any time with effect for the future (e.g., via email to datenschutz@sennheiser.com or by written request to Sennheiser electronic SE & Co. KG, Am Labor 1, 30900 Wedemark, Germany). The withdrawal has no effect on any data processing that takes place up to the time of the withdrawal. Upon receipt of the participant´s withdrawal, the Organizer immediately cease data processing to the extent of the withdrawal. The participant shall be entitled to revoke the consent given at any time by notifying the Organizer with effect for the future.

If the participant withdraws consent to the use of the data for participation in the raffle before the date for determining the winner, a participation shall not be possible any longer.

Participants are entitled to the following additional rights as a data subject towards Sennheiser electronic SE & Co. KG:

· Right to information - The right to know what data is processed and in what way.

· Right to rectification - The right to request that incorrect and out-of-date personal data be rectified.

· Right to erasure - The right to have personal data deleted.

· Right to restriction of processing - The right to restrict data processing.

· Right to data portability - The right to have personal data transferred directly from one system to another (in machine readable form).

· Right to lodge a complaint – The right to lodge a complaint with the supervisory authority responsible for Sennheiser electronic SE & Co KG. The contact details are:
