The below Terms and Conditions and the Privacy Notice attached as Annex (hereinafter together “Terms and Conditions”) shall apply to this promotion conducted by Georg NEumann GmbH.
By entering its data and the required details, participant accepts these Terms and Conditions.
1. Organizer
This promotion is organized by Georg Neumann GmbH, Leipziger Straße 112, 10117 Berlin, Germany (“Organizer”).
2. Who can participate?
1. Anybody who is of age according to the applicable laws at the venue of their ordinary residence may participate in the participating countries.
1.a) Participating countries are:
Austria, Albania, Bulgaria, Belgium, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Israel, Ireland, Italy, Latvia, Lichtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Norway, Poland, Portugal, Romania, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, UAE, UK, Vatican City, Iceland, South Africa, Turkey, Ukraine
2. Excluded from participation are employees of the Organizer and companies affiliated with the Organizer or their employees.
3. Acknowledgement of and compliance with these Terms and Conditions is a prerequisite for participation.
4. Only one participant per household is eligible to take part in this promotion.
5. Organizer may exclude participants if they attempt to influence this promotion in an unfair and/ or dishonest manner, such as but not limited to:
1. Purchase via a non-authorized dealer
2. False or misleading statements regarding participation.
3. Violation of the terms & conditions of the promotion.
How does it work?
a. Firstly, participants must have purchased an U 87 Ai Studio Set from an authorized Georg Neumann GmbH reseller between November 15, 2022 and December 31, 2022 to be eligible to apply for a free Neumann NDH 20 headphone.
b. Secondly, participants must upload a proof of purchase for verification of date of purchase and item purchased on the Neumann promotion landing page.
c. Thirdly, on the same page participants must enter the serial number of their U 87 Ai Studio Set.
Finally, you will receive a confirmation email right after sending your data to us with a request for verification. Hereto, you should respond to as stated therein.
4. Procedure
a. The participant shall read and hereby agrees to these Terms and Conditions and the Privacy Notice in full before participating.
b. The Participant shall give the contact data correctly in the form of the email address and thus confirm that the address given is the respective correct address.
c. Only participants having completely and correctly completed the entry forms and who comply with these Terms and Conditions shall be entitled to participate in this promotion.
d. Each participant can only participate once during the term of this promotion.
e. Any participation using automated procedures or similar devices or procedures shall not be permitted.
f. If the newly purchased U 87 Ai Studio Set is returned to the authorized Georg Neumann reseller until February 28, 2023, participant loses the eligibility to participate in this promotion and must return the Neumann NDH 20 headphone if he has already received it. To ensure no return has been made, Organizer will check the invoice and serial numbers with the authorized Neumann dealer.
g. All purchases of an U 87 Ai Studio Set made other than through authorized Georg Neumann resellers, i.e. through ebay, amazon etc., do not qualify for participation in this promotional campaign.
5. Place and period of participation
Registration is possible online on the Neumann promotion landing page between November 15, 2022 (00:01 CET) and January 31, 2023 (23:59 CET) for purchases made between November 15, 2022 (00:01 CET) and December 31, 2022 (23:59 CET).
6. Shipment of the Neumann NDH 20 Headphone
The shipment of the Neumann NDH 20 headphone will take place only after 30 days of data entry and no later than February 28, 2023.
Any shipment charges that may occur at the participants receiving end, i.e. customs and taxes, will not be covered by the Organizer but by the participant himself
7. Data protection
While conducting the promotion, personal data of the participants will be processed in accordance with the attached Privacy Notice (see Annex below).
8. Suspension, Interruption or Termination of the Raffle
The Organizer reserves the right to terminate, suspend terminate the promotion at any time in its sole discretion.
9. No cash out
The value of the NDH 20 headphone cannot be paid out in cash.
10. Liability
The Organizer is liable for intent and gross negligence. In the event of slight negligence, the Organizer shall only be liable for breach of a material contractual obligation (“Kardinalpflicht”), the fulfilment of which is essential for the proper performance of the contract and on the observance of which the participant may regularly rely, as well as for damage resulting from injury to life, body or health.
11. Applicable Law; Venue; Severability Clause
These Terms and Conditions and any disputes arising out of or relating to it shall be governed by the laws of the Federal Republic of Germany without regard to its conflict of laws rules and without regard to the UN Convention on Contracts for the International Sale of Goods (CISG). Any legal action or proceeding shall be brought before the competent courts in the Federal Republic of Germany at Hannover, Federal Republic of Germany.
If any provision of these Terms and Conditions is held invalid or unenforceable by any court of competent jurisdiction, the remaining provisions of these Terms and Conditions shall remain in full force and effect.
ANNEX - PRIVACY NOTICE
The following personal data can be processed while conducting the promotional campaign:
• master data (e.g. first name, last name)
• address data (e.g. street, postal code)
• contact data (e.g. telephone number, e-mail address)
• individual data in relation with the respective raffle.
The processing is based on the consent of the participants according to Art. 6 para. 1 a) GDPR.
Any data collected from the participant shall be used by the Organizer only to conduct the campaign and in particular to send out the NDH 20. Any other use beyond the purposes described herein or any disclosure of personal data to any third parties shall not occur. In particular, the collected data shall not be used for any other marketing purposes.
The personal data collected from the participant will be deleted as soon as the purpose required for processing has been achieved. Due to legal requirements, different retention periods may apply.
The participant has the right to withdraw his consent at any time with effect for the future (e.g., via email to datenschutz@sennheiser.com or by written request to Georg Neumann GmbH, Leipziger Straße 112, 10117 Berlin, Germany). The withdrawal has no effect on any data processing that takes place up to the time of the withdrawal. Upon receipt of the participant´s withdrawal, the Organizer immediately cease data processing to the extent of the withdrawal. The participant shall be entitled to revoke the consent given at any time by notifying the Organizer with effect for the future.
If the participant withdraws consent to the use of the data for participation before the shipment of the NDH 20 headphone, a participation shall not be possible any longer.
Participants are entitled to the following additional rights as a data subject towards Georg Neumann GmbH:
Right to information - The right to know what data is processed and in what way.
Right to rectification - The right to request that incorrect and out-of-date personal data be rectified.
Right to erasure - The right to have personal data deleted.
Right to restriction of processing - The right to restrict data processing.
Right to data portability - The right to have personal data transferred directly from one system to another (in machine readable form).
Right to lodge a complaint – The right to lodge a complaint with the supervisory authority responsible for Georg Neumann GmbH. The contact details are:
